So, hub and I need to draw up a separation agreement to send in with our other divorce papers. We don't have children or own any property and we are completely amicable with no issues to contest. Is this something that we can write up on our own?


I mean I think we can, but can anyone tell me what language to use and what points we have to touch upon? We really don't want to pay for a lawyer, we just want to do this quickly and simply.


Can I just write something like what I wrote above? Would that be enough?


Any advice is appreciated.

Thank you! Have you ordered from them before? Maybe I should call the court again and see if they give out the forms. I thought the sep. agreement was something that had to be drawn up from scratch. I didn't know it was a "form." Hmm, anxious and confused. Weird that they charge for them. Big thank you though!

I wish the divorce process was as simple as the elopement process.

I know when my dad divorced his first wife, they drafted up the papers themselves and delivered it to a notary and that was that.  They had two kids too and never got a lawyer involved.  That was in the late 70s though, so maybe times have changed.  I'm certainly not a lawyer, but I would think that for people that are in your situation, it shouldn't be too difficult.

Yeah, I was told we just need a notary to sign it. I wonder if something as simple as "We, Ms.x and Mr.x have no children, property or assets and nothing to contest" would be enough.

Okay, so I think i'm good. I called the court and they are mailing me the form. For whatever reason you have to request it from them. They don't just send it out with all of the other paperwork. *sigh of relief* Thanks ladies!

I don't know if you live in a community property state, but if you do, be sure to address any debts outstanding if there are any.  One of ours wasn't addressed & it has caused huge issues.
