HELP!!! store won't refund my money

Ok, I need advice from you ladies!! Less than a week ago (thursday) i bought a pair of APC jeans from a small boutique near my house.  With tax, they were $176.  I didn't even wear them (just tried them on in my house), and the zipper broke off, like the teeth broke off and the pull went to the other side of the track.  Never in my LIFE has that happened to a pair of jeans for me, nor a zipper.  I work with designers, and we use the industry standard (YKK) which doesn't break, if so, RARELY.  This was just a crappy zipper.  So i was SO MAD- but i loved the jeans, so i went there and she nicely exchanged them for me.  I didn't even try the second pair on or anything- and the zipper came apart again, teeth falling out, etc.  SO BADDD for $176 jeans- i've spent $20 on jeans and had them last longer- i didn't even WEAR these.  So I go back today, and they won't refund my money.  Its been less than a week, they've never even been worn.  I didn't want store credit (i only had the money for a pair of jeans, they didn't have others) so i gave them the jeans and walked out.  The girl there talked on the phone with the manager who remembered me, but still said she wouldn't refund them because she hadn't had problems with those jeans before.  HELLO!!! I didn't even WEAR them and it happened TWICE!!  So now i just have a $176 charge sitting on my cc and no merchandise.  What should i do??  Any other experiences in similar situations- i want some consumer protection!  I already called my cc, and am filling out a credit dispute form when it arrives.  Has anyone had any good experiences with that?  I have a Visa.  If that doesn't work, anyone else I can contact?  I'm soo soo mad, what kind of honest person wouldn't give someone there money back?  They never stated their return policy to me, nor was it on the receipt, and even so, its not like i simply didn't like them or changed my mind- they were defective TWICE.  someone please calm me down and re-assure me

that is total bs! it sounds like the only way to go will be to go thru visa. you might want to call the manager at the store and tell them that you are filing a dispute with the cc company- alot of times that will scare a store into giving you what you want, because they get charged a fee when someone does this for the investigation. and usually they honor the customer in a dispute like this. that is so frustrating, pls keep us posted on what happens...

Am I mistaken or did you also use the $$ from the reward for these? Was that you?


Anyway, this is a sucky situation. Not nice salespeople suck, too. APC jeans are not made here in the US, so that really sucks too. You could call up the company & see what they say. Send an email..give the store name...who the saleperson was.


I think they are in France.


 


Otherwise, talk to the mgr at that store. Don't get pissed. Do it as calmly as possible. It never helps when one gets upset.

I did buy them on the same day- i didn't use the money from the reward though- used my cc- thank gosh i didnt use cash.  but i was thinking this...like,,,would i have gone in the store if i hadn't taken the money?? is this my punishment?  but, i was gonna go in the store anyway- i'd seen a dress i'd wanted earlier. 


Has anyone had good results from credit disputes?  I've never done this before but it is such bs.  I feel sick almost because of it.

I don't think it's punishment. You seemed to handle that situation fine.


I think it depends on your card company. I have had good luck with mine when I have had problems, though I got threatening letters from the other side. However, I just told them to deal with my card company.


 


I think I would try again with the store. Call the mgr. Explain the issue. There's got to be something you can do. And if she doesn't fix it, tell her you have a million friends on ST that will give their store a bad name..haha..That's not nice, but it's a great threat.

you can also contact the bbb. a similar thing happened to me at a steve madden store. long story short i bought a pair of shoes and then wanted to return them. i took them back the next day and the sa was like all sale merchandise is final. i was with my mom, and we were like we weren't informed of  that policy at the time of purchase. then the sa turned the sign that had the return policy around, it was facing him, and pointed to the all sales final part. anyway we disputed it with the bbb and they returned our money. it took about a month though.

Honey- how did you go about contacting them?  Is it pretty easy to get your money back through them?  Do they contact the store for you or what?  I am really mad- i didn't do ANYTHING to the jeans.  Just zipped them up once and broken.

my mom did most of the leg work on it. and this was before the heyday of the internet, so it might be easier now. also iirc we did the same thing you did, left the merchandise, and then contacted them.

it seems as though you just need the company's info. and the bbb will do the legwork. i would go through them & file a dispute with your cc company. good luck, i hope it works out.

Many times when I have purchased items at a boutique, I have had to sign something on my receipt that acknowledges I will not be able to make a return for refund, only store credit is allowed....and there is often a very short return time allowed, like a week or 14 days.


As long as they didn't present their store policy to you like this and you didn't sign anything, then you should be ok.

I've disputed cc charges through discover a few times and it was really easy and cleared up within a week.  Discover lets you dispute something the minute it shows up on your statement via internet dispute form.  You should see if Visa will let you do this too.  It will speed up the process.  Just tell them you bought the defective jeans and returned them and the store has not and is refusing to credit your card and you do not have the merchandise.  Dates and times are helpful too.  Don't worry Visa will protect you.  My parents disputed 2 claims with Visa and things turned out ok.

Nope they never made me sign anything or even told me that they do store credit only.  Which even if they did..the jeans were defective and they can get money back from the vendor- we do RA"s for quality issues all the time.  So basically- they're not out anything really- just my profit.

What assholes!! I don't have any good advice that hasn't already been said but I'd definitely file a complaint with the BBB. They're not terribly useful but at least if anyone else ever calls, they'll see they have complaints.


I've done cc disputes before and it's always worked out well. Good luck!
