Apartment Rental Question

My landlord called me last month and asked if I would be renewing the lease. I said I didn't know because my lease was up in August. Now yesterday she called me again, and I did not answer but I know this is what she is going to ask me. She said in our previous conversation that she had trouble renting the apt. before me and she wanted to start to adverstise as soon as I know if I am staying or not. Well here is my problem, I know for a fact that I am moving because I am moving from the area, but I don't want to tell her this because I don't want her to list my apt, because I don't want realtors bringing people by. My lease isn't up til August and I want peace until then. So my question is that is she allowed to list it this early and have people come through? And don't I only have to give her a month's notice to begin with? Thanks.

I would check your rental agreement.  Most places require only 30 days notice.

I just read my lease, it does not say anything about having to give a notice. It is a real short lease pretty much just documenting what I pay and what she pays and the rental period.

well, then there you have it. she has no protection in regard to anything that isn't included in the lease. technically, there is no law (at least that I'm aware of) that requires notice.  out of courtesy you can give her a month's notice, but there's nothing requiring you to do that. you can give her one week or one day notice as far as that's concerned.

as others have said if there's nothing in the lease then you have no obligation. 1 month is standard. i think it would also depend on your relationship with her. if she's nice then you might want to tell her now. i'm sure she would notify you before anyone came by.


another thing to think about is your deposit. i'm n/s if you paid one and it was equivalent to a month's rent (i know i paid a month & a half) but if you piss her off and you're not planning on using it to cover your last month, she might take her own sweet time to return it. just something to think about.

Yeah I paid one month ahead, but I am going to use it for my last month. I am a little pissed at my landlord because I tell her different things that need to be fixed in my apt., little things like the back sliding glass door is off its hinges due to the hurricane and she has done nothing about it. There have have been little things like that, that she does not respond to. So I am not looking to do her any favors. I figure I would just her a month's notice. I also paid a security deposit. But if she wants to take her time returning it, it is fine.


Also my last apt, that I was in before I moved here, they decided to sell it. I was there for a month when they were trying to sell it and it was a pain to have people look at your apt. I know it sounds weird but it sort of like an invasion. The realors who came by always gave me attitude. Neadless to say it was a bad experience.

I would tell her nothing until 30 days before you are leaving. You don't owe her anything!
