About a month ago I had written to you girls that I had sold a Sex and the City DVD set. Then when the buyer received it she claimed that the plexi-glass case it came with was cracked.I had put the set in a sealed, bubbled wrapped envelope, and I was pretty surprised that it could have been cracked. So thanks you you girls advice I offered her a refund on the shipping and she agreed to that without any problems. Consisdering she had paid insurance.


Now one month later I get this from her:


"hi again. i know we spoke before about the cracked case on this item. i have since given it to my sister, and upon her watching it, she found the set is indeed missing disk three of season 2. as a result, i would like to send this product back for a full refund. since it is cracked (and i was not able to get a replacement) and the disk is missing, it is of no use to me. perhaps you left the disk out at home or in a dvd player. i am sure once u find it, the set can be resold. thank you for your help and timely response:) lindsay"


 


Prior to sending out the dvd set I verified that set no more than 3x's flipping every page and I standby that all dvds were in that set. Now she has filed a dispute against me at Paypal, and I have responded with fighting that dispute. I emailed C.S. from Ebay, and they emailed me with: perhaps try calling her to resolve this, apply for a final fee value credit, or if that cannot be resolved file an unpaid dispute.


I don't know what to do, I don't mind refunding her money, but upon returning my dvd set I expect to have all my dvds in there, just like I sold it to her. I really could use your advice thankyou!!!!!!!

I wouldn't accept a refund.  I would rather suffer any consequences that may occur as a result of fighting it.  She admitted the set left her possession and was informed by a third party that a DVD is missing.  She is liable in my opinion.  Since she was not in posession of the item you cannot confirm this is indeed the case (that the item was not in there when it was in her posession).  I don't think you should be expected to take the word of a third party.  Good luck and let us know how it turns out. 


ETA: I would forward the email to Ebay and Paypal and state the case that the item in question left her hands and because she was informed by another person the item was missing then you are not responsible.  Assert that the person indicating the item missing could have simply damaged or lost the DVD and since you know it was in there when you sent it and she never indicated it was missing when she received it and complained about the cracked case, then she doesn't have a case.

I agree with Drew.  I would fight it based on you sent it and the only thing she complained about was a cracked case not a missing disk.  Obviously it was in there when she checked and found the crack and now it is missing.  Tell her too bad and say that with Ebay & Paypal.  I swear its getting to the point you can only accept money orders from people because of Paypal.

This person is probably seeking crack money.  Don't you think she would have inspected all the DVD's where there upon arrival?  And if one was missing, she would have stated it when she saw the so called crack in the case.
