If anyone is interested in buying this boot in brown it's available in size 38 at Go Clothing, they have a coupon code for 20% off which gives you a savings of $55 and it's free shipping. Plus if you live outside of CA, I think it's tax free.
I'm so bummed I wear size 40. I had to order mine from Urban only saved $20. Most places are sold out, except Zappos. These boots are popular I guess.

i know i could look it up myself, but what is a 38 again?  i'm 8.5-9 american.  not like i should buy these anyways, and i'm not outside cali, but just curious!

I think 38 is around an 8 or a large 7.5

when i read about these in Shop Etc. and Lucky they both mentioned the fact that the shaft was sized a bit larger to accomodate stuffing your pant legs in to them... so my guess is that they were a bit more roomier than other boots. hth!
