I am so mad w/my landlord right now I could scream.  My BF and I live in a bldg. that's managed by a property management company.  So our "landlord" is C - she is the one you go to w/any issues, maintenance requests - you get the picture.  Last fall, we had an issue when it rained that water was leaking in our bedroom and one set of our living room windows.  We live in a loft-type apartment, so the windows are 15 foot high - and the water is coming in from the top of the windows.  As you can imagine - this is a nightmare.  We reported it and after about a month and a half they told us that they were going to have a tuckpointer come out and fix it, but then decided that cost too much money, so instead, they cauked the outside of the windows themselves.  It held for a while, but then last night, it was pouring out and I came home to find water coming through the windows again - our windowsiles were soaked...I emailed her this morning to tell her they are leaking again and she replies by saying this - "I will let maintance know of the issue, but I'm not sure if anything can be done."  I wrote back and said "You're telling me there's a possibility that we may have to live w/water leaking in our windows?"  She wrote back and said it's a possibility.  WTF!!!  That does not seem right to me at all - how is that acceptable?  I'm seriously seeing red I'm so mad.

I would check your state and local laws to see what rights you have in this situation.  Most states have laws to protect you from stuff like this so that you can break your lease and move out without incurring penalties.  I think that this is pretty unsanitary and unacceptable and I would make sure to write a formal complaint and document this instance and others.

that is not acceptable at all. it should be part of your lease that they are responsable for upkeep of building maintance- I would think that if they refuse to fix this problem you are well within your right to break the lease (since they broke their end) or sue.

I am definitely going to look into my rights, but the thing is - I want the windows fixed.  I don't want to move.  I love where we live and we don't have the means to move somewhere else right now.  Our lease is until April 30, 2006 and we had planned to relocate after that - so I'd really hate to move now..it's just not really feasible for us.

check the laws where you live and maybe you can pay for it yourself and deduct that amount from the rent.?

Yep, you can do this if they refuse to fix the problem or if they don't fix it in a reasonable amount of time. Check your local laws though. In Austin there's something called the Austin Tenant's Council, which has most questions and answers relating to landlord/tenant law on the site. I'm sure there's something like that where you live. Maybe check out your newspaper and read some of their back issues in the "ask the legal expert" section (every newspaper has something like that, right?). They'd probably list their sources. Or maybe check out legal aid and see if they have a list of resources available.

yes, yes, i know what ya mean, as we have a land lady that will take her time on fixing things on our house, and you know as well as me, there will be things they wont fix. but they do expect to have there rent money  on time, [and i do]  it realy does get to you, [i know] and they go up on your  rent as well,  when they wont.  hope things get better for you.     hello kittie
