I have a lease question - my roommate is moving out in mid-May. She says that, because I told her not to find a subleaser (she was going to look on Craigslist and I don't trust her judgment, plus I'd really like to live alone) that I will have to sublease from her. This doesn't make any sense to me as I am already on the lease. Is she correct?

Also, she told me she is only going to pay 1/3rd of the rent because she's moving out on like the 10th. If she were living alone and her lease ended in May, she'd have to pay the whole month's rent, right? I don't see why she should be able to pro-rate her rent because she needs to move out early.

I also think my roommare thinks that I'll forget about the cable/utility bills for May. Would it be fair for me to make her pay a portion of the bills for May? I mean, she'll be here for one third of the month, and it seems fair to me.

Prorated rent is generally acceptable in CA if someone is moving in or moving out mid-month.

It sounds fair for her to pay a portion of the utilities.

No idea about the sublease issue - that sounds odd to me. Won't you be paying the full rent directly to the LL?

Thanks Suasoria! I guess her paying 1/3 of the rent for May is fine.

I qill be paying the full rent directly to the LL which is why it sounded weird to me too. I guess she'll have to go talk to the leasing office and see what they say.

1. Prorated rent is an established norm. It sucks, but think about it from her position. I've had it swing both ways, I've both left a lease early and paid the prorated rent amount and I've also had people leave early and I've had to suck up the difference. It's only fair, especially since she is giving you warning.

2. Subleasing from her? WTF is that? Unless you're under some weird primary and secondary leasee arrangement with the landlord, you're cool.

However...I would get a new lease written up as soon as she leaves. That way, any damage that she might have done can be deducted from her part of the security deposit. I think it's also just safer in general to have a new lease established with the landlord that doesn't include her in the slightest.

That's what I would do...that doesn't sound like subleasing to me either. If your name is on the lease you are leasing from the LL
