some of you might remember some days ago my car (the transmission) broke while I was in Ithaca (I live in Buffalo) and I had to take the car to Toyota even though the transmission is under warranty (for the guys in B that fixed it).
Well, Toyota says (of course) that it's a transmission problem, and thewant 3500+$ to fix it. I don't want to pay it, it's not worth for this car, besides the guys who did the job in the first place should take care of it. They have been telling me that they are looking for someone who colud tow the car from I to B for 4 days now.
At this point, upon several phone calls from me, and the visit from a friend who asked them what was going on and what they are planning to do (no, they are not gonna pay for a car rental), they are starting to say that it probably it's not a transmission problem and it's not their fault. Good thing I went to toyota, so I have a second opinion and they say IT IS the transmission.
Now, the qyestion. I am pretty sure at this point I'll have to take this thing to the small claims court. My feeling is they are trying to waste time until I give up and pay for it myself. It really helps that I am a woman and I have a forign accent: the best subject to rip off
Today I'll ask toyota to put in writing what their evaluation of the problem is. Then I should do the paperwork, but I really have no idea how to do it (I am not from the US).
SOme of you more familiar with law could give me some advice? I'll also ask my friends -I am going back to Buffalo today-BY BUS!
Aw, that sucks! I have no ideas or advice for you... I just really feel for ya! Car problems are the worst, aren't they? Especially when it seems like people are trying to take advantage of you. Don't let this go, and I hope everything works out in your favor.
