How to deal w/ gym monster
Permalink Closed

Okay, I need some advice on how to deal with this issue I'm having with my old gym.

Back in January 2004 I signed up for a 16 month gym membership and had the payments automatically deducted from my debit card every month.  Back in April was the last time I was billed by my gym, so thinking that my gym membership was done, I stopped going and haven't heard a WORD from them until this weekend.

Then, I got a bill from them in the mail saying I owe $252 for my gym membership from May-August and that I have multiple $25 charges on my account because they were not able to charge my credit card.  So, I called the VP of Operations to clear this up and she is still insisting that I need to pay for the membership because I had a box checked off in my contract that says I would go from month to month after the contract expired.  She said she'll erase the $25 charges, but I still would owe $150 something.  She faxed me all of my information and the wrong credit card number is listed.

I don't think I should pay because had I known I was still being charged, I would have dropped the membership back in May.  I have no idea why they have the wrong credit card number for me, but I was billed each month for the 16 months that I was a member, so I don't know why they're having a problem with my credit card now.  My account number didn't change and neither did my bank.

My question is:  Who is right?  What do I do about it now?  We've gone around in circles for the past few days and now I'm having old statements looked up for me from my bank to prove that I was charged when I was still under contract.  I think I'm right, obviously, but am I?  I think she should erase all charges and I'm thinking that if she doesn't, I'll go to the Better Business Bureau about it.  She's also not the nicest person to deal with:  she's argumentative and keeps insisting that I'm wrong about pretty much everything.

I'm not looking for validation here, just ideas/opinions as to how you all think I should resolve it.

You really are right. Being that they charged the correct credit card number for so many months and then mysteriously had the wrong credit card number immediately after your membership expired, something is obviously wrong on their end. I'm sure you have explained this to the nasty woman at HQs. Had you been notified at the end of your contract, this wouldn't have happened and I would say as much to this gym nazi!

Gyms are NOTORIOUS for this sort of thing!  You are absolutely right in this, so don't let them talk you into paying a dime!  Demand to speak to this asshat's manager - then put it all in writing, with a CC: in the bottom corner to your credit card company.  They do this because many people will just apologize and pay for it, so the thing they said about a box being checked saying that you'd continue month to month after your contract expired is probably completely fabricated.  If they insist, make them send you a copy of whatever document that is with your signature on it.  I doubt they could!
