Company's failure to pay??

My company failed to pay me my last paycheck (I should have received it on Friday).  I  have contacted them and they have not responded yet.  Does anyone know what actions I can take to get my paycheck?  Thanks!!

Find out if your company is part of the retro pay program. Retro pay is usually handled by the HR department, they would be the ones you would have to contact. Once they've done the research they should have your check for you ready in two days. Or when this happened at my work, I would encourage employees (who this happened to) to speak to the manager, and have him/her do a "cash out" from the store funds, for the amount that you should have gotten paid. Then once you receive the your money from the corporate office you just pay them back.

My company does retro pay if someone is promoted and has a pay change that isn't immediately reflected on their paycheck (when I was promoted, I was payed my new payrate retroactively from the official date of the promotion, not the date that it hit payroll), if that's what you mean. 


As far as speaking to the manager (I was the manager and there isn't a replacement) and doing a payout---my paycheck will excede the cash in the register and the company doesn't allow payouts (for any reason), so that's not even an option.  


My issue is that this company is so screwed up and unethical that I'm afraid something shady happened to my paycheck.  I've never had an employee not receive a paycheck for any reason (unless it was a company-wide problem, which happened way more often than it should have).  Grrrr....I need my paycheck!!!

Do you typically have direct deposit?  When I left my last job, the company had to give my last check as a live check instead of direct deposit, and this took an extra week.

Ack! I just got it in the mail.  I've never heard of the company doing this before.  Everyone else always has to pick up their checks from the store, even if it's their last check.  My boss must think I'm such a moron that she didn't want me to come back in the store, so she had it sent to my house instead.  I wasn't aware someone else could authorize that on my paycheck.

I'm glad that you got it.But for the future........I know in Connecticut and in many other states companies can be required to pay you out whatever you've wprk right there on the spot on the last day.I've had to process them at my store before.


Also I hope if you had any vacation time left they paid you out for that too.If not please look into it.It's the law that you are paid for it...................even after you've left the company.

unfortunately, Pennsylvania law doesn't require an employee to be paid out on their last day.  And also, in this great state of PA, employers aren't required to pay out any unused vacation days (the laws vary from state to state).  Lots of companies do pay it out anyway as a courtesy, but my company is so freaking cheap that they don't.  I forfeited two weeks of paid vacation (not that I would have been allowed to take it-- the DM blacked out all but two weeks in June, neither of which would have worked for me). So, either way, I wouldn't have gotten my vacation.  Lucky you to live in a state that values vacation time and pay!!!


I am so glad I'm out of that place!!

Tara is correct. Once you no longer are employed with a company they are forbidden access to your bank account. Which means.. if you have direct deposit, your last paycheck at any job will always come to you as a regular check that you will have to go and deposit yourself. It is against the law for them to access your account, even for a deposit, after your last day of employment. This happened to me at my last job, most companies will follow it to avoid future conflict.

Yeah, I know.  I had direct deposit and was aware that my check would be a live check, I just thought that it would go to the store (that's what the other companies I've worked for have done and that's what happens with other employees).  Still not sure why mine came directly to my house, but oh well.  I was just concerned when it wasn't in the store b/c this company messed up my paycheck 4 times in 9 months, so I thought this might be another screw up.

After hearing about your old boss, she probably requested that it be mailed directly to you, so she would not have to see or talk to you when you came in to pick it up!! She is that crazy!

Hehe...that's what my mom said.  But my boss wouldn't have seen me anyway (she lives in Florida and was only in the store once a month).  But yeah, I wouldn't be surprised if she wanted to 'keep me away' and requested to send it to my house.  She was a nutbag.  Apparently, now she is terrorizing one of the assistants, who also just put in her two weeks.  It can't be good when the entire management team from one store all quit within a three week time period.
