some ebay questions

sorry don't know where else to post this.

1. i know that is against ebay policy to contact the seller and offer to buy an item after the auction is ended, but if an auction is still going on can i contact the seller and see if she can add a buy it now option to it? (assuming no one has bid on it yet.)

2. has anyone ever tried to file a claim with paypal's buyer protection? i was reading all the rules, and  i think i qualify since the seller sent me the wrong item and has not responded to my emails yet. i'm just trying to figure out how many hoops i have to jump through to get my money back in case the seller doesn't respond to my last email. tia!

to answer #1, I think it is legal, as lomg as the auction will still go through the ebay system. I did this when I bought my sister's MJ bag. The seller told me to bid at whatever the price was (it was like $30 at that time), and then she closed the auction early. When she sent me the invoice, the "shipping and other fees" category was the balance of the cost we agreed on.  I think ebay allows that as long as it still goes through their system. In any case, people do it all the time!
